{{PD-Italy}} requires photographs to have been created prior to 1976 to be in the public domain in the United States, but this is dated as being taken in 1978. As such, this photo had its copyright restored per c:COM:URAA and is non-free in the U.S. That's makes this a non-free file, but it would not qualify for fair use for violating both WP:NFCC#1 and 8. plicit 00:45, 26 March 2025 (UTC)[reply]

This album cover was originally published in the US without an attached copyright notice (source: eBay). It is thus in the public domain due to failing formalities and should be transferred to Commons as {{PD-US-no notice}}. JohnCWiesenthal (talk) 19:19, 26 March 2025 (UTC)[reply]

Comment - This is not how we handle transfers to commons. See Wikipedia:Moving files to Commons. You should replace the copyright tag with that yourself, replace the fair use with a simple information, and then select "Export to commons" and export it to commons this way. Once this is done, the file will be tagged for deletion automatically. You don't need to open a FfD for this.
I don't believe I can currently do this until this discussion is closed, so I'm commenting so that you can withdraw this and perform this action yourself, or someone is able to procedurally close this per the policy above.

These album covers were published in the United Kingdom without an attached copyright notice (sources: Discogs [for Sgt. Pepper's Lonely Hearts Club Band {the "notice" on the back cover appears to apply only to the lyrics}], Discogs [for Yellow Submarine], Discogs [for Abbey Road], Discogs [for Let It Be]) and were published in the United States within thirty days. Per c:COM:HIRTLE, they are thus in the public domain in the US due to failing formalities and should be relicensed as {{PD-US-no notice}} and {{Do not move to Commons|reason=US only|expiry=20XX}} (2038 for Sgt. UK works do not need a copyright notice for copyright to exist. It will exist regardless of the presence or absence of a notice. This does not affect their status in the US as US law only requires that something is in copyright in its 'home' country, not that it carries a copyright notice for other countries (although obviously it needs the US side of the formalities to be completed in full). Long story short, these are very much IN copyright in the UK and the US and need no relicensing. - SchroCat (talk) 09:01, 27 March 2025 (UTC)[reply]
