We must not delete said image, because it falls under wikipedia's free-image domain. If the photographer claims that it is them, then we must give the photographer the benefit of a doubt. • Cloud Gate is a copyrighted sculpture, and in the US freedom of panorama does not extend to sculptures (see Commons:Freedom of panorama for more details).
